This is nothing against wonderful contributions by We hope, who had extensively made research about copyright notices and registrations of various works yet... well, hasn't edited for two years. However, this image is used not just in a Billboard magazine advertisement but also as part of the original vinyl gatefold release of Joni Mitchell's 1974 live album Miles of Aisles (see discogs and eBay listing). Also, the live album has the copyright notice on the back cover, "(P)(C) 1974 Elektra / Asylum / Nonesuch Records", indicating that the record labels owned by Warner Bros. hold copyright to not only the whole album recording but also more likely the images associated with the album, including the photo also used for a Billboard magazine ad. I am unsure why the ad lacked copyright notice, but the fact that the ad didn't have a notice doesn't make the photo ineligible for copyright, especially when the album contains the copyright notice.
